Filing a Provisional Patent Application secures an immediate priority date and gives you a 12-month window to file the formal utility application while legally using the term "Patent Pending".
What is the difference between a provisional and non-provisional patent?
  • Provisional Patent: Acts as a one-year placeholder that secures an early filing date and allows you to use the term "Patent Pending". It is never formally examined by the USPTO and requires fewer formalities to file.
  • Non-Provisional Patent: The formal, legally binding document that is thoroughly examined by the USPTO and, if approved, matures into an actual issued utility patent.
Can I patent an idea without a prototype?
Yes. The USPTO does not require a working physical prototype to grant a patent. You only need to provide a sufficiently detailed description and drawings that allow someone skilled in the field to recreate the invention without undue experimentation (known as "enablement").
How do I know if my idea is already patented?
You must conduct a thorough Prior Art Search. While you can use free tools like Google Patents or the USPTO database, hiring a patent attorney to perform a professional search is highly recommended to uncover obscure filings, international patents, and interpret complex legal claims before you invest in filing an application.
Can I patent an app or software idea?
Yes, software and mobile applications can be patented as utility patents if they provide a specific, novel, and non-obvious technical solution to a problem. However, abstract ideas or generic computer implementations are strictly prohibited. A patent attorney is essential to draft software claims that comply with complex USPTO guidelines.
What cannot be patented?
The USPTO strictly prohibits patenting:

Does a US patent protect my invention internationally?

  • File a PCT (Patent Cooperation Treaty) application within 12 months of your US filing.
  • The PCT streamlines the process to seek patent protection in over 150 member countries.
  • After the PCT phase, you must file national applications in each specific country where you want protection.
Do patents expire?
Yes. Patents do not last indefinitely:
  • Utility patents generally expire 20 years from the earliest filing date, provided maintenance fees are paid on time.
  • Design patents expire 15 years from the date of grant.
Once expired, the invention enters the public domain and anyone can legally manufacture, use, or sell it.

What is the difference between a patent and a trademark?
Patents and trademarks protect different types of intellectual property:
  • Patents protect inventions, processes, and functional designs (e.g., a new engine mechanism or smartphone software).
  • Trademarks protect brand identity, such as names, logos, and slogans (e.g., the Nike swoosh or the Apple logo).
Many products require both—a patent for how it works, and a trademark for how it is branded.
How much does it cost to register a trademark?
The USPTO charges filing fees ranging from $250 to $350 per class of goods or services you wish to protect. Professional attorney fees for conducting a comprehensive clearance search and preparing the application typically add an additional $1,000 to $2,000, ensuring your mark doesn't infringe on existing brands and is highly likely to be approved.
How long does it take to get a trademark approved?
On average, registering a trademark with the USPTO takes 12 to 18 months from the date of filing. If an examining attorney issues an Office Action (a formal rejection or request for clarification) or a third party opposes the registration, the process can take significantly longer.
Do I need an LLC or corporation to get a trademark?
No. Individuals (sole proprietors) can apply for and own a federal trademark. However, many business owners prefer to register trademarks under an LLC or Corporation to protect their personal assets from business liabilities and to easily transfer ownership if the company is sold.
Can I trademark a clothing brand name or logo?
Yes, clothing brands frequently trademark their names and logos. You must file the application under the appropriate USPTO Nice Classification (typically Class 25 for clothing and apparel) and provide specimens showing the mark used on tags, labels, or the garments themselves.
What is a Trademark Specimen?
A trademark specimen is real-world evidence submitted to the USPTO proving that you are actively using your trademark in commerce to sell goods or services. Examples include:
  • Photographs of your logo on product packaging or tags.
  • Screenshots of your website selling services with the trademark clearly visible.
  • Marketing brochures or menus (for services).
Do I need to register my trademark if I already use it locally?
While using a brand locally gives you "common law" rights in your immediate geographic area, federal trademark registration provides massive advantages:
